The Hostel’s 77 General Terms and Conditions of Business

Valid from 1st May 2017

In these General Terms and Conditions of Business the Hostel 77 is named "Einfach Übernachten Bern GmbH" based at Morillonstrasse 77, 3007 Bern.

1. Area of application

These General Terms and Conditions apply to all legal relations between "Einfach Übernachten Bern GmbH" and the guest.

2. Lodging agreement and options

  • By the receipt of the written, telephonic, electronic or personal booking and the delivery of our confirmation, a contract is concluded between the guest and the "Einfach Übernachten Bern GmbH". These General Terms and Conditions are an integral part of this contract. Notifications by e-mail are deemed to have been made in writing.

  • If a lodging agreement in writing is requested, this is to be returned to the "Einfach Übernachten Bern GmbH" within 10 days after receipt. Otherwise the reservation is invalid.

  • The price including additonal services and visitor’s tax, confirmed by "Einfach Übernachten Bern GmbH", has to be paid at check-in.

  • Option data are binding for both parties. The "Einfach Übernachten Bern GmbH" can automatically dispose of the reserved rooms after expiration of the period of validity, provided the guest has not sent a written confirmation.

3. Price change

Particularly in the following cases, the "Einfach Übernachten Bern GmbH" can change the prices published:

  • newly introduced or increased government taxes (such as VAT, visitor's tax, etc.)

  • clearly explainable printing errors

4. Payment in advance

The "Einfach Übernachten Bern GmbH" is entitled to request a payment in advance to guarantee the booking. If a payment in advance is requested, the same has to be made by the due date stated. If the amount due does not arrive at the agreed date, the "Einfach Übernachten Bern GmbH" can automatically dispose of the room(s).

5. Cancellation conditions

Single bookings (direct booking):

  • Free cancellation until 1 day before arrival (except special offers). A cancellation within 24 hours prior to arrival will be charged the amount of the first night. This deadline is reimbursed by 12 noon on the day of arrival.

  • The "Einfach Übernachten Bern GmbH" can refuse access to the guests without giving any reason. There is no accommodation requirement.

  • If you have reserved a room without guaranteeing the reservation by credit card, the Hostel will keep the room for you until the agreed time of arrival. If you do not appear until this time, the "Einfach Übernachten Bern GmbH" can automatically dispose of the room (s).

Group bookings (10 persons and more):

  • Until 31 days prior to arrival: cancellation without any costs

  • 30 to 15 days prior to arrival: 30% of the arranged price

  • 14 to 5 days prior to arrival: 50% of the arranged price

  • 4 to 0 days prior to arrival: 100% of the arranged price

These conditions are also valid for the reductions according to the group number or the length of stay.

External Booking Channel

If you booked using an external Booking Channel, you can only cancel your booking through the same service and subject to the conditions of that service.

6. Arrival

Check-in is possible during the reception opening hours. Guests who have not made a payment in advance are kindly requested to arrive by 6.30 pm or to call and announce the late arrival by telephone. Otherwise the "Einfach Übernachten Bern GmbH" can dispose of the reserved bed(s).

7. Data protection

Based on Article 13 of the Swiss Federal Constitution and the data protection regulations of the Federal Government (DSG), every person is entitled to protection of their privacy as well as protection against misuse of their personal data. The "Einfach Übernachten Bern GmbH" is committed to guaranteeing you a high level of data protection and security. The personal data gathered in the course of the booking process (such as your name, e-mail address, etc.) will be stored by "Einfach Übernachten Bern GmbH" and used for a proper handling of your reservation and stay at Hostel 77. In addition, we use this data anonymously for statistical and analytical purposes. Your personal data are treated confidentially and are not passed on to third parties.

8. Legal venue

The contractual relationship with "Einfach Übernachten Bern GmbH" is exclusively applicable to Swiss law (excluding Swiss collision law). The exclusive jurisdiction for any disputes is Bern. The "Einfach Übernachten Bern GmbH", however, has the right to sue also at the residence of the guest.
